Terms of Business and code of Conduct
Students attention is drawn to the following terms of business (we regret that the school cannot accept responsibility for any misunderstanding arising from a students neglect to read the printed conditions. If you are in any doubt, please raise the matter with the staff).
CLAUSE 1 THE DRIVING APPOINTMENT CARD
This document remains the property of Eric's Driving School and must be produced or returned upon on request.
CLAUSE 2 Driving Licence is required
Students must be possession of a current full or provisional driving licence at all times when driving in a school car.
CLAUSE 3 Tuition fees
(a) The price of the driving lesson can be located on at the school's premises or by phone 01225 706071
(b) These prices are reviewed regularly and we reserve the right to amend these prices. If however prices are increased we will notify the student on there next lesson.
(c) Monthly accounts will only be considered and approved by the proprietors to students, 18 years and over and NO discount will be given.
(d) An interest charge equivalent to my credit cards interest percentage will be added to all accounts outstanding for more than one calender month, any legal costs arising from the students neglect to pay on time, will also be added to their account.
( e ) Payment for all driving lessons is accepted by cash up to the age of 18 years, If you are aged 18 years or over,then by cash, or cheque, guaranteed by a valid cheque card.
Pay Pal, or other credit / debit cards will not be accepted.
( f ) Driving lessons must be paid for on or before the day that they are taken as no credit is given
Clause4 Postponement of driving lessons by the School.
( a) If by reason of vehicle failure,the instructors illness,or any other emergency that the school has to postpone any lesson,the student will be notified as soon as possible by phone or text, and a revised appointment will be scheduled with mutual agreement.
( b) If such postponement shall cause the cancellation of a Driving Test, the school shall reimburse the student with the test fee that is lost,if the student has paid in advance.
(c) If by reason of car failure during a Driving Test, such Driving Test is abandoned by the examiner, the school shall at the students option (1 or 2).
(d) (1) Pay for the Driving Test fee and provide a car for the next Test if the abandoned test has been paid for in full including the use of the car.
(e) (2) Refund the Driving Test fee and the cost of the car ( if paid for in advance ), if the student prefers to make their own arrangements.
(f) If a student has missed or cancelled a booked driving lesson at short notice, then any Refunds due back to the student will be made after deducting the same proportion of costs incurred by the driving instructor /school for missed or late cancellations of booked driving lessons by the student, that were unable to be rebooked to another student at short notice,( as under clause 5,)
( g ) The driving instructor/ school shall not be held liable for any further costs incurred by the student by not taking a booked,driving/Theory Test,
( h ) In a dispute first contact the driving instructor/school to see if it can be resolved,
( i ) Except as provided in (a) above,if the school postpones a Driving lesson it shall give to the student such notice as may be required of students for their cancellation of the lessons under the schools terms and conditions ( see clause 5 ).
Clause 5 postponement or cancellation of driving lessons by students
(a)Two clear days notice of postponement or cancellation of lesson appointment is required.The notice period does not include the day on which it is served,the day of the appointment,Saturdays,Sundays,Religious and public bank holidays,( the period of notice is flexible ),for example if the student agrees to rebook their lesson in the same week.
(b) Notice shall be deemed to have been served from the day on which the communication is received at the schools published address, notice served by telephone or email will be confirmed.
(c) Where the school receives due notice in (a) and (b) above,the fee for that or those lessons if paid for in advance shall be refunded or assigned to a lesson or future lessons at the students option.
(d) Where lessons are cancelled without due notice,or the student fails to attend as arranged,unless the school is able to re-book the time with another student no credit will be given.in the case of a late cancellation the school will endeavour to re-book the time if possible.
(e) Where by reason of late cancellation,a students fee is non-refundable,( as in ( d ) above ) allowance will be made for such savings at the school as a result of the car not being in operation.
CLAUSE 6. Postponement or Cancellation of Driving Test Appointment
(a) Students attention is drawn to the notice period of cancellation of the driving test, required by the Driving Standards Agency . you must notify your intention to cancel or postpone a driving test appointment at least 3 days before such test is due to take place. you can cancel either on the internet, by phone, or by mail, if by mail First class post by recorded delivery is recommended. the address is on your appointment card, or go to. www.direct.gov.uk/drivingtest
(b) If necessary, the school will advise a student at least eight days prior to the test date ( except if on an intensive course ) of the advisability to cancel a driving test and can then except no responsibility for any loss of the driving test fee if the student neglects to send or notify the traffic area office ( see A above )
(c) The school can accept no responsibility for the driving test appointments or cancelled test by the driving standards agency. It will, however, advise as to the procedures to follow if the driving standards agency finds it necessary to cancel a driving test at short notice.
CLAUSE 7. Communication with the school
(a) Students may send letters to the address shown on the lesson appointment card or on the internet web site or may leave messages by telephone at the numbers given in publications.
(b) Letters received will be date stamped on the day they arrived, telephone messages will be recorded in the telephone message book, showing the date and time of the call and by whom it was received. The dates and times shown in the school records shall be deemed to be the effective time of receipt of such communication.
(c) In respect of students personnel information, all email addresses, postal addresses, telephone numbers, names, financial data, progress reports recorded by Eric's Driving School will be treated with care. All recorder information will be stored safely and all information no longer required will be deleted beyond reconstruction.
CLAUSE 8. Driving Instructors
(a) The school guarantees that all instructors shall be legally entitled to give driving instruction for money or monies worth in compliance with section 126 (1) of the road traffic act 1972.
(b) Instructors official driving standards agency authorising documents may be inspected on request, students are invited and encouraged to ask to see them.
CLAUSE 9. Change of Instructor
(a) Students wishing, for any reason to change there instructor should notify the principle or his /her appointed representative.
(b) If for any reason, such request cannot be granted the student shall have the right to cancel any further lessons and be entitled to the return of any unexpired fees paid (less transaction costs incurred up to the amount of 3.7% ) in advance provided that due notice has been given in accordance with the terms set out in this document
(c) The school reserves the right to appoint such instructor to conduct a lesson as circumstances require or necessity demands in order to comply with its contractual duties at law to give lessons at stated times.
(d) For the purpose of ensuring satisfactory supervision of instructors it may be necessary for a supervising instructor or a driving standards agency supervisor to be present in a tuition vehicle during lessons. This, in certain circumstances, is a legal requirement, in the public interest. such additional persons will in no circumstances take any part in the instructors work or duties. They are present strictly as observers.
CLAUSE 10. Duration of lessons - use of school's car for Driving test
Unless otherwise arrange, driving lessons will be of 1 hour, 1.5 hours and 2 hours duration. Lessons which include the driving test will be charged from the time of pick up to the time of arrival back to the Students destination, usually 2 - 3 hours.
(a) Applications for the Driving test are advised when the students progress is expected to be maintained and his or her future co-operation anticipated. It does not imply that the required standard " has been" reached nor that it will for certain, be attained on the appointed day. The school will make every effort to ensure that the required standard is reached but, if necessary will not hesitate to advise postponement or cancellation, if by so advising postponement, the students interest and/or public safety will be best served.
(b) The school reserves the right to with hold the use of the school car for the purpose of a driving test if, in its considered opinion, the student has not for any reason reached a satisfactory stage of driving competence. This sub-clause is intended to save students time and expense, unnecessary failure and consequential delay in obtaining a full driving licence.
CLAUSE 11. Driving Standards Agency Recommended Syllabus
Eric Driving School uses the syllabus recommended by the driving standard agency, (as can be found in "Your driving test"
Complaints Procedure.
If you have a valid complaint about Eric or Eric's Driving School.
(1) Contact Eric or Eric's Driving School immediately detailing your complaint to see if it can be resolved. address and contact details at the top of the page.
(2) If it cannot be resolved you then have the option to change your driving instructor or driving school.
(3) If you need recourse to take the valid complaint further you can.
